Application

These terms and conditions apply to the sale and delivery of services by Green Circle Energy Ratings Ltd and to all statements made by Green Circle Ratings Ltd on the internet, in advertisements, brochures, pricelists and quotations, verbally or in writing. By placing your order with us, you are deemed to have accepted these terms and conditions.

Orders

Orders are only binding when accepted by Green Circle Ratings Ltd.

Price & Payment Terms

Quoted prices are valid for 30 days. Prices are quoted on the basis of a product and subject premises described and will not apply to any other product or premises. Unless otherwise stated, all prices relate to the rating of a dwelling not exceeding 200 square metres (2,153 square feet) and are Includive ofVAT and charges by sustainable Energy Ireland (SEAI) for registration of a rating. Payment will be made before supply or service unless prior agreement has been reached to credit terms. In the event of late payment interest will be charged at 7% above the European Central Bank (ECB) base rate applicable on all overdue sums. This penalty is in line with the European Communities (Late payment in commercial Transactions) Regulations 2002. Green Circle Ratings Ltd reserves title to every rating it has registered until it has been paid for and reserves the right to delete any registration that has not been paid from the national BER Register after seven days notice in writing of this intention to deregister.

Accessibility and Safe Working Conditions

Green Circle Ratings Ltd accepts orders on the basis that the premises to be rated is accessible and is a safe environment in which its employees can work without danger to their health or safety. If it is not possible for our BER Assessor to access a premises or to carry out a BER assessment safely, we will not be obligated to carry out the work and will not refund the fee for that has been paid by the client.

Cancellation Policy

Green Circle Ratings Ltd reserves the right to cancel assessments without cause and to rearrange at a later date. If an assessment is cancelled by Green Circle Ratings Ltd, the customer will have the right to a full refund if the alternative appointment offered is not to his/her satisfaction.

Clients will have the right to cancel an assessment appointment 24 hours before it is scheduled to happen and, in the event of force majeure to cancel it at any time. Cancellation later than 24 hours before the appointed time will result in a cancellation fee of 10% payable when the appointment is re-scheduled.

Ownership

The ownership of a building energy rating and advisory report passes to the owner of a premises or his/her agent on payment in full of the amount owing to Green Circle Rating Ltd.

Data Protection

to collect and hold information required for the building energy rating and the related commercial transaction
to pass information regarding your premises to Sustainable Energy Authority of Ireland for registration on the 'National Administration System' for building energy ratings and for such other pursoses as they may properly require (e.g. in the context of an audit of the BER Assessment.

Your data will be held and/or transferred in accordance with the applicable data protection laws.

Subcontracting

The company may subcontract its obligations to a competent third party.

Waiver

A waiver by Green Circle Ratings of any of the foregoing conditions shall not constitute a general waiver of such condition.

Consumer Rights

Your statutory consumer rights are not affected by these terms and conditions.

Jurisdiction

These terms adn conditions shall be governed by and interpreted in accordance with the laws of Ireland.

Complaints and Notices

All complaints and notices must be in writing (email to corporate@greencircle.ie) , by hand, post to the registered office of the company. Notices sent by post are deemed to have been delivered 48 hours after posting.

Miscellaneous

Green Circle Ratings may subcontract its obligations to a competent third party. All notices must be in writing (by hand, email to corporate@greencircle.ie , post to the registered office of the company deemed delivered 48 hours after posting).
